Terms of Service

Welcome to RacewayIQ (the "Service"). These Terms of Service ("Terms") govern your access to and use of our website, software, calculators, reports, downloadable content, APIs, and related services.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Purpose of the Service

The Service provides engineering and electrical design assistance tools intended to assist users in performing calculations, generating reports, and evaluating engineering concepts.

Current tools include, but are not limited to:

  • Conduit Fill Calculator
  • Pull Box Sizing Calculator
  • Voltage Drop Calculator

Additional calculators and engineering utilities may be added in the future. The Service is intended solely as an informational design aid and should not be relied upon as the sole basis for engineering, procurement, installation, construction, inspection, permitting, or code compliance decisions. Users must independently verify all calculations and determine their suitability for the intended application.

2. Not Professional Engineering Services

The Service does not provide professional engineering services, engineering certification, legal advice, code compliance certification, inspection approval, permit approval, or construction approval. Nothing on the Service constitutes professional engineering advice or creates an engineer-client relationship.

3. User Responsibility

You are solely responsible for verifying all inputs, reviewing every calculation, confirming assumptions, checking manufacturer documentation, reviewing project specifications, reviewing applicable electrical codes, verifying local amendments, and confirming Authority Having Jurisdiction (AHJ) requirements.

The Service should never be the sole basis for engineering, procurement, installation, construction, or inspection decisions.

4. Calculations May Contain Errors

Although we strive for accuracy, calculations may contain programming errors, software defects, bugs, incorrect assumptions, incomplete or missing data, rounding differences, outdated code editions or references, interpretation differences, or user input errors. The Service does not guarantee that any output is complete or correct. Users must independently verify all calculations and results before relying on them for any purpose.

5. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING ACCURACY, RELIABILITY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AVAILABILITY, AND NON-INFRINGEMENT. WE MAKE NO GUARANTEE THAT ANY CALCULATION OR RESULT IS CORRECT.

6. No Guarantee of Code Compliance

References to codes or standards are provided for convenience only. The Service does not guarantee compliance with the National Electrical Code (NEC), local amendments, state regulations, utility requirements, manufacturer instructions, project specifications, or AHJ interpretations. Users are solely responsible for compliance.

7. Engineering Disclaimer

The calculators are intended only as design aids. They are not substitutes for professional engineering judgment, manufacturer documentation, utility requirements, contract documents, field verification, or AHJ approval. Every calculation should be independently reviewed before implementation.

8. User Assumes All Risk

By using the Service, you acknowledge that you assume all risks associated with any calculation, recommendation, export, report, or other output generated by the Service. You alone are responsible for any design, purchasing, installation, construction, inspection, permitting, or code compliance decisions made using the Service. Your use of the Service is entirely at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR PROPERTY DAMAGE, PERSONAL INJURY, DEATH, LOST PROFITS, LOST REVENUE, LOST CONTRACTS, LOST DATA, DATA CORRUPTION, CONSTRUCTION DEFECTS, CODE VIOLATIONS, INSPECTION FAILURES, REWORK COSTS, REPLACEMENT COSTS, BUSINESS INTERRUPTION, INDIRECT DAMAGES, INCIDENTAL DAMAGES, CONSEQUENTIAL DAMAGES, SPECIAL DAMAGES, EXEMPLARY DAMAGES, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Maximum Liability

In no event shall the Company's aggregate liability arising out of or relating to the Service exceed One Hundred U.S. Dollars (US $100), to the fullest extent permitted by applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its owners, affiliates, employees, contractors, licensors, and agents from and against any claims, demands, actions, liabilities, damages, judgments, settlements, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your use of the Service, reliance on calculations or reports, design or construction decisions, violation of these Terms, or violation of applicable law.

12. Reports and PDF Exports

Any exported PDF or report is informational only. It is not a sealed engineering document, permit document, inspection approval, construction drawing, or certification of compliance.

13. Acceptable Use

Users may not reverse engineer the Service, copy proprietary calculations, scrape data, build competing services from the platform, circumvent security, upload malicious software, or abuse APIs. Users may not use the Service or its outputs to train, improve, or develop machine learning models, artificial intelligence systems, or competing automated calculation services without the Company's prior written permission. Violations may result in termination.

14. Accounts

If account access is enabled, you are responsible for maintaining the confidentiality of your login credentials and for activity under your account. Signed-in account features may include PDF export access, saved calculation history, favorites, renamed calculations, and future project tools. We may suspend or terminate accounts that violate these Terms, attempt to bypass security, or misuse the Service.

15. Intellectual Property

All source code, software, algorithms, calculation methodologies, formulas, databases, graphics, layouts, documentation, reports, trademarks, branding, trade dress, user interface designs, and related intellectual property remain the exclusive property of the Company or its licensors. No ownership rights are transferred through use of the Service.

16. License

Users receive a limited, revocable, non-exclusive license to use the Service. No resale or redistribution rights are granted.

17. Future Features

The Service may expand to include additional calculators, APIs, reports, and engineering tools. These Terms automatically apply to future features.

18. Third-Party Services

The Service may integrate with or rely upon third-party providers, including authentication providers, cloud hosting providers, analytics providers, payment processors, database providers, and other vendors. We are not responsible for the availability, security, accuracy, or performance of any third-party services.

19. Data Storage

Unless an account, calculation history, project-saving feature, analytics feature, or report-handling feature is expressly provided, calculations are processed in the browser and are not intended to be permanently stored by the Service. Users should maintain their own copies of important reports and calculations.

20. Service Availability

The Service may be unavailable due to maintenance, outages, upgrades, or circumstances beyond our control. We do not guarantee uninterrupted access.

21. Privacy

Use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and processing of information described therein.

22. Changes to the Service

We reserve the right to modify, suspend, or discontinue any feature, calculator, or functionality at any time.

23. Changes to These Terms

These Terms may be updated periodically. Continued use of the Service constitutes acceptance of revised Terms.

24. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which the Company is organized.

25. Dispute Resolution

Before filing legal action, both parties agree to attempt informal resolution. To the fullest extent permitted by law, disputes shall be resolved through binding arbitration on an individual basis. Class actions and class arbitrations are waived.

26. Severability

If any provision is held unenforceable, the remaining provisions remain in effect.

27. Entire Agreement

These Terms constitute the entire agreement between you and the Company regarding the Service.

28. No Reliance

You acknowledge and agree that the Service is provided solely as an informational tool and design aid. You are not relying on the Service as a substitute for independent professional judgment, engineering review, manufacturer documentation, project specifications, field verification, or Authority Having Jurisdiction (AHJ) approval. The Company does not warrant that the Service is suitable for any particular project, installation, jurisdiction, or application. Users remain solely responsible for independently verifying all calculations and determining their applicability before use.
